Delaware City does not run its own civil court. All civil cases from the city go to the Leonard L. Williams Justice Center at 500 N. King Street in Wilmington. The building holds the Superior Court, the Court of Chancery, the Court of Common Pleas, and Family Court. Hours are Monday to Friday, 8:30 AM to 4:30 PM.

The Superior Court line is (302) 255-0800. The Court of Common Pleas is (302) 255-0900. Chancery is (302) 255-0544. The Prothonotary is (302) 255-0777. Six public access terminals on the first floor are available by appointment for in-person research.
Delaware City Superior Court Civil Records
Civil cases over $50,000 from Delaware City go to the New Castle County Superior Court. The Prothonotary's office on the first floor of the Justice Center holds every civil case file. A Superior Court civil filing fee runs $175 and up. The $10 Court Security Assessment Fee is added to each filing. Technology fees of $0.50 per document apply under Rule 79.1. Copies are printed by the clerk at per-page rates set by Civil Rule 77(F). Civil cases in Superior Court can take a year or 18 months to reach a final judgment.
Common Pleas and Chancery for Delaware City
For civil claims up to $50,000, the Court of Common Pleas is the right office. Email CCPNCC_CivilFilings@delaware.gov for records requests. The state page is courts.delaware.gov/CommonPleas. A civil complaint filing fee is $85. A name change petition is $85. A JP Court appeal runs $135.

Delaware City FOIA and City Records
The Town of Delaware City uses a FOIA Request Form for city record requests. The form goes to Town Hall at 407 Clinton Street. The FOIA Coordinator is Britney Loveland. Call 302-834-4573. The form asks for your name, address, email, phone, and a clear description of the records you want.
Under 29 Del. C. § 10003, the city has 15 business days to respond. The city may provide the records, deny the request, or ask for more time. What Delaware City Civil Records Contain
A civil case file for a Delaware City matter has the same core parts as any other New Castle County file. The file starts with a complaint or petition. The court then adds motions, answers, orders, and the final judgment. The docket is the running log of each event.

Delaware City Records Retention
Superior Court civil case files are kept for 20 years after final disposition. Judgments are held forever. Docket books and indices are also kept forever. Common Pleas cases run 7 years. JP Court civil cases run 5 years. Chancery case files are held permanently. Guardianship records run 10 years after the case ends. Trust proceedings run 20 years after the trust ends.
Records of historical value may go to the Delaware Public Archives in Dover rather than be destroyed. The archives also hold old deeds, wills, and tax lists for the town. Staff can do basic lookups by email at archives@delaware.gov or by phone at 302-744-5000.

The library is at the Kent County Courthouse in Dover, and is open to the public.
